Low Level DUI vs. High Level DUI in Ohio

Low-level DUIs are offenses where your blood alcohol level is between .08% and .16%. Anything higher than that is considered a high-level offense and comes with stricter penalties. In Ohio, refusing a breathalyzer test automatically places you in the high-level category for punishment.
1st DUI Offense Penalties in Ohio

Low-Level Offenses
In Ohio, for a low-level offense, you’ll face a minimum of 3 days in jail or 3 days in a Driver Intervention Program, which can be avoided with an Interlock.
You may also face up to 5 years of probation, fines up to $1,075, and be ordered into alcohol treatment. Your license could be suspended for 1 to 3 years. To get your license back, you’ll need to pay $475.00 and obtain an SR-22 Bond. Additionally, 6 points will be added to your driving record.
Recently, the Ohio Legislature passed a law that introduces new DUI testing methods for officers, and fines for such offenses are increasing. These new regulations will take effect in April 2025.

High-Level Offenses
In Ohio, for a high-level DUI offense, you’ll face a minimum of 6 days in jail or 3 days in a Driver Intervention Program, followed by 3 days in jail. The main difference between low-level and high-level DUI offenses is the amount of time spent in jail.
2nd DUI Offense Penalties in Ohio

Low-Level Offenses
For a second DUI offense in Ohio, you’ll spend a minimum of 10 days in jail, with a maximum sentence of 6 months. Your license may be suspended for 1 to 7 years, and you’ll face fines ranging from $525 to $1,625.
If your DUI is alcohol-related, you’ll be required to use an Interlock device, and your vehicle will be immobilized for 90 days.
Additionally, the judge may order you to display the yellow “party” plates on your vehicle.

High-Level Offenses
For your second high-level DUI in Ohio, the mandatory jail time doubles, while the other penalties remain largely the same. The exception is that you will be required to have the yellow “party” plates on your vehicle.
3rd DUI Offense Penalties in Ohio

Low-Level Offenses
For a third DUI offense in Ohio, you’ll spend a minimum of 30 days in jail, with a maximum sentence of 1 year. Your license will be suspended for at least two years, and you’ll face fines ranging from $850 to $2,750.
You may also be required to undergo mandatory substance abuse counseling, surrender your vehicle, and have the yellow party plates on your car.

High-Level Offenses
For a high-level DUI offense, you’ll face all the same penalties as a low-level offense, except for the jail time. For a high-level DUI, you’ll spend 60 days in jail, with a maximum sentence of 1 year, instead of the 30 days for a low-level offense.
